Waiver

Considering that:

• SKYLAND PARK S.R.L., a commercial company with its headquarters in Cluj Napoca, str. Tudor Vladimirescu, no. 2-4, building C3, ground floor, Cluj County, registered at the Trade Register under no. J12/103/2019, C.U.I. 40417679, carries out activities of roller skating and entertainment (hereinafter referred to as "activities") at the location situated in Aushopping Iris Commercial Center, Bdul. Muncii, no. 1-15, Cluj County, on a skating surface;

• These activities are conducted in accordance with the Internal Operating Regulations and the provisions of this participation agreement (hereinafter referred to as the "Agreement");

• I wish to participate in the activities organized and hosted by SKYLAND PARK S.R.L., a commercial company headquartered in Cluj Napoca, str. Tudor Vladimirescu, no. 2-4, building C3, ground floor, Cluj County, registered at the Trade Register under no. J12/103/2019, C.U.I. 40417679 (hereinafter referred to as "Skateland"); and

• I have been informed that the activities may involve risks, known or unknown, that injuries may occur to myself or to other participants.

I declare on my own responsibility the following:

I. RISKS OF PARTICIPATION IN ACTIVITIES

I am aware that, by participating in the programs and activities offered by Skateland, including but not limited to roller skating events and parties, skating lessons and training, services provided with rental skates or my own skates, as well as any other activities organized by Skateland at locations operated by Skateland, there is a risk of bodily injury to myself.

The risks and dangers include, but are not limited to: falls, trips, collisions with other participants or objects, equipment malfunctions or failures, scratches, bruises, and sprains; eye, joint, or back injuries, broken bones or contusions, loss of consciousness, serious injuries, including paralysis and even death. These risks are evident and inherent in roller skating and may be amplified by my actions, the actions of minors, or the actions of other participants.

I consciously and willingly assume these risks, known or unknown, even if they result from the negligence of others, taking full responsibility for my participation in the activities carried out by Skateland.

I have been informed and I am aware that the activities involve risks, regardless of the care taken.

I declare that I will only attempt activities that I feel capable of performing safely. I commit to participating in Skateland's activities in a manner that does not cause injury or harm to myself or to other participants. Any injury to a participant or any other person present, caused by non-compliance with the Internal Operating Regulations, will be solely attributable to the participant responsible for the violation of the Internal Operating Regulations and this Agreement.

I agree to conduct these activities in accordance with the rules that have been explained and presented to me, and I will follow the instructions given by the Skateland staff. If I observe any aspects that could threaten my safety or the safety of other participants, I will immediately inform the Skateland staff.

I understand that safety equipment, such as knee pads, wrist guards, and helmets, are recommended. I understand that it is solely my responsibility to use protective and safety equipment and that, in the absence of such equipment, regardless of the fault of anyone, I will be solely responsible (for myself and/or for the minors I am responsible for and on whose behalf I sign this agreement).

If the conditions for the skating activity are not safe or there is any form of discomfort, including regarding my physical and/or mental condition, I will immediately stop participating.

II. PHYSICAL AND MENTAL CONDITION OF THE PARTICIPANT

I understand that individuals involved in the activities conducted at Skateland must be in good physical condition according to their age, gender, and height.

Situations that may cause discomfort during activities include, but are not limited to: fainting, dizziness, loss of consciousness, hypertension, chronic bronchitis, severe asthma, rheumatic fever, pneumothorax, liver or lung conditions, thyroid, adrenal, or other gland disorders, chronic bone conditions or arthritis, blood disorders, severe anemia, chronic ear or sinus disease, severe head injury, or any other condition that requires regular medical treatment.

I understand that I am responsible for any accidents if I suffer from any of these conditions or any other medical condition.

I declare that I am physically and mentally fit for all activities conducted by Skateland without assistance or support.

I declare that I am not under the influence of alcoholic beverages, hallucinogenic substances, narcotics, or any other substances that may affect my physical and/or mental condition and endanger myself or others.

I agree that if any Skateland staff member suspects that I am intoxicated, hallucinating, dizzy, hyperactive, or under the influence of psychotropic substances, they may deny me access or immediately interrupt my participation.

I declare that I am not taking any medications or substances, whether prescribed or otherwise, that could affect my ability to participate in activities.

I declare that I do not have any physical or mental disability that could affect my ability to participate in activities. If I do have such disabilities, I confirm that they do not present any foreseeable risks.

If I sign this Agreement on behalf of minors, I confirm that I am aware of their health, skills, and abilities, and I consider them fit for skating. If at any time the conditions seem unsafe for minors or if they experience any form of discomfort, including in terms of their physical and/or mental condition, I will immediately stop their participation. I agree that Skateland staff have the authority to interrupt or deny minors access to the skating rink if they consider it justified, as I trust the judgment of an adult regarding the physical and mental condition of minors.

III. LIMITATION OF LIABILITY

I understand that access to the skating surface will only be allowed after signing this Agreement.

I acknowledge, understand, and agree to comply with all safety rules and procedures, as well as the rules included in Skateland's Internal Operating Regulations. I understand that failure to comply may result in immediate denial of access to Skateland's location and a ban on future participation in activities organized by Skateland.

I declare that Skateland will not be held responsible for damage to my personal belongings or the belongings of minors under my care, nor for any damages caused by the carelessness or negligence of Skateland.

I declare that Skateland will not be responsible for any injury to myself or the minors under my care, caused by my actions, the actions of other participants, or the actions of the minor under my care. Given the inherent risks of the activities facilitated by Skateland, which I am aware of and accept, I assume full responsibility.

I have read, understood, and agreed to the Skateland skating safety rules, and I have also explained them to the minors under my care.

IV. FINAL PROVISIONS

Failure to comply with any provision of this Agreement or the Internal Operating Regulations constitutes a breach for which I am solely responsible, and Skateland is released from any liability.

I assume full responsibility for damages caused to third parties due to my negligence or carelessness during activities, fully releasing Skateland from any responsibility.

This Agreement remains in effect for the entire duration of participation in activities conducted at Skateland after it is signed.

I FULLY ASSUME THE RISKS and responsibility for any injuries, damages, death, or costs resulting from my participation or the participation of minors under my care in the activities at Skateland.

I have carefully read this Agreement. I fully understand its terms, including the limitation of Skateland's liability, and I sign it voluntarily.
